Description
You are an intern with the Director of Public Prosecutions (DPP) service in Victoria working under the supervision of solicitor, Ms Jude Justice. Ms Justice recently received several documents contained in a “Working Brief of Evidence” from a case that Senior Constable Sherlock Holmes is investigating. The investigation started after
events transpiring in Victoria in February 2021, which resulted in the death of Donnie Watkins and Kira Watkins. Constable Holmes is unsure of what crimes, if any, to charge suspect Frank King with committing for criminal prosecution. He seeks advice from the DPP.
Ms Justice has assigned you to work on this case. She wants you to examine the documents provided by Constable Holmes in his Working Brief of Evidence and answer the following questions:
1. Should criminal charges concerning Donnie Watkins and/or Kira Watkins (relating to unlawful homicide and/or assault) be brought against Frank King?
2. Should criminal charges concerning Amanda Watkins (relating to assault offences) be brought against Frank King?
3. If yes, which criminal charge(s), on what ground(s)?
4. If no charges should be brought against Frank King, Ms Justice would like a legal explanation why not? Ms Justice has issued the following instructions concerning this assignment:

-You must clearly articulate the legal basis for your charging decision advice. This will require you to:
o identify legal issues arising from the facts of the case;
o clearly communicate your approach to resolving these legal issues;
o engage in a discussion or analysis to resolve the legal issues (ie, show your legal reasoning); and
o identify which charge(s) you recommend and the source of law (ie, common law or statutory) for those charges.

-Using legislation and jurisprudence relevant to the subject matter will be of critical importance to effectively engage in the legal reasoning necessary to complete this assignment. Most of the resources necessary to your discussion can be found in the assigned MLL114 unit work. You can find a list of all of the assigned reading materials on the CloudDeakin site under Content; Reading List. However, you will also have to engage in independent legal research.
