a) Explain whether or not the following relatives of Manee can make a combined application with (be included in) Manee’s application for the Partner (Temporary) (Class UK) and Partner (Residence) (Class BS) visas:
i. Her 10-year old son, Rab, who is with her in Australia as a secondary subclass 300 visa holder.
ii. Her widowed mother, Preeda, who is in Australia on a subclass 600 visa.
b) Based on your answers to (a) above, calculate the total visa application charge for the combined Partner (Temporary) (Class UK) and Partner (Residence) (Class BS) subclass 820/801 visa application.

You must support your answers by reference to the relevant legislative provisions.

Bachelor of Arts degree at Griffith University in Brisbane and is looking forward to starting his course
in the next Trimester.

Would your answer be different if instead of simply expiring, Aksel’s subclass 500 visa had been cancelled under section 109 of the Migration Act? Explain by reference to the legislation.

Sebastian, a citizen of Colombia, arrives at your office seeking advice about staying in Australia. He tells you he arrived in Australia almost two years ago on a Temporary Activity (Class GG) (Subclass 408) visa, which is still valid but will expire in a month’s time. You do a VEVO check and discover that there is a condition 8503 on Sebastian’s subclass 408 visa. Sebastian met Kylie, an Australian citizen, shortly after he arrived and they soon formed a relationship. Sebastian and Kylie married three months ago.
They proceeded to prepare their own application for Sebastian to obtain a partner visa. They lodged applications for a Partner (Temporary) (Class UK) (Subclass 820) visa and Partner (Permanent) (Class BS) (Subclass 801) visa three weeks ago. However, Sebastian shows you a letter he received from the
Department last week stating that his application for the Partner (Temporary) (Class UK) and Partner
(Permanent) (Class BS) visa was invalid.
Sebastian advises you that he is desperate to stay in Australia as Kylie has just been diagnosed with
Multiple Sclerosis and he cannot bear the thought of having to leave her now when she needs his
support. He doesn’t understand why his partner visa application was rejected as invalid. He is
determined to obtain a visa to remain in Australia and wants your advice.

With reference to the relevant legislation, why was Sebastian’s Partner (Temporary) (Class UK) (Subclass 820) and Partner (Permanent) (Class BS) (Subclass 801) visa application deemed invalid?

What steps would Sebastian need to take to be able to validly apply? Based on the facts provided, do you consider that he has good prospects of being able to apply?

Jenny arrived in Australia in January 2019 on a subclass 600 visitor visa with a 8101 “no work” condition. However she did work, and was caught. As a consequence, the Department cancelled her visa under s116 of the Migration Act because she worked in breach of her visa condition. She left
Australia voluntarily 3 days after her visa was cancelled and returned to the UK. She would now like to apply for another subclass 600 visitor visa.

Do these facts raise any issues that may prevent Jenny from being granted this visa at this point in time?
