On 30th January 2021, The Guardian published an article regarding the World Health Organization urging the UK to pause its vaccination programme after vulnerable groups have received their jabs to aid the fair distribution of the COVID-19 vaccine globally.[1] WHO spokeswoman, Margaret Harris, appealed to people in the UK to wait and help ensure equitable global distribution as it is ‘clearly morally the right thing to do’. António Guterres, the UN secretary general stated earlier in mid-January that governments had a responsibility to protect their people, ‘but “vaccinationalism” is self-defeating and will delay a global recovery’. He emphasised that ‘Science is succeeding, but solidarity is failing’ as ‘Vaccines are reaching high-income countries quickly, while the world’s poorest have none at all.’
Human Rights Watch has also urged governments to take all possible measures within their power to ensure the scientific benefits of research funded by public money are shared as widely as possible. This is believed to have a positive impact on maximising ‘vaccine availability and affordability within the shortest possible time’ and prevent the ‘unacceptable prioritization of profit for some over benefit for all’. Among concerns and recommendations raised in the Human Rights Watch report, it emphasises barriers related to technology transfer and IP and pricing, which is not only important for the COVID-19 vaccine but equally relevant to other COVID-19 health
technologies including testing and drugs.  In light of the above statements, discuss the effects of inequitable access to COVID-19 vaccines on economic output. Your discussion should also address the question of the extent to which, from a legal point of view, companies and other (inter)national institutions should share data, know how, and IP - including through open and non-exclusive licences – in order to prevent a situation which would allow drug companies ‘to play god’ and ‘decide who gets a vaccine and when.’
In your answer, please make sure you discuss the statements listed below. Where applicable, you should make suggestions for specific areas potentially needing reform or policy changes:
1. How vaccines are distributed will expose the divides by race, class, and economic power.

2. Global competition around vaccine allocation will dominate in the short run
3. Even if nationalistic behaviour is inevitable, there are economic incentives to provide access to vaccines across the globe as soon as possible
4. It is imperative for international and national institutions to make public health-related patent regulations a priority concern and to do their utmost to overcome the medical supply shortage faced by states that lack developing capacity.
