Legislation
The task is to complete the FOUR activities as a way to provide an overview of legislation and policy documents that underpins education in your relevant state or territory. The response is to be written and formatted in a “report style” and NOT an essay. Reports use topic headings, lists and tables to clearly and succinctly present the
information to the reader.

1. Education Acts and Departmental Strategic Plans 
This task is to critically review the Education Act and the education department’s strategic and/or operational plan relevant to the state or territory where you reside or intend to seek a teaching appointment. For example, in the Northern Territory, the Education Act (NT) Objects (1-s3) and its Guiding Principles (1–s4); and the NT Department of Education Strategic Plan (2018-2022 – Strategic Framework) underpin schooling operations. Using the relevant documents for your state or territory, consider how a typical secondary school complies with the objects, guiding principles and plan. Locate a copy of a typical high school’s annual report and use this source document to determine the school’s compliance to their state or territory legislation and their education department’s strategic and/or operational plan. For your response, prepare a review paper and:
describe how the school complies, and,
critically review how the objects are being achieved, the guiding principles and strategic plan are followed, and suggest ways that improvements can been initiated.

 

2. Teacher Registration Acts and Regulations
This task is to describe the professional responsibilities and compliance of a “typical” teacher based at a school to requirements of their relevant state or territory teacher registration legislation. For your response, prepare a short fictional case study and:

  • describe how this teacher complies to their relevant Act, and,
  • critically analyse any impediments that may occur that may cause some teachers to be unable to renew registration and suggest ways that these impediments may be remedied.

 

3. Criminal Code of States and Territories
This task is to review two accounts of scenarios involving unprofessional conduct of Australian teachers that have been reported in the media and the criminal prosecution has been closed. The criminal cases should include incidents where a child was harmed or exploited, or prosecutions involving indecent articles, gross indecency or sexual intercourse. The Criminal Code (NT) has specific sections (s126-s140) relevant to offences against morality and includes (a) child abuse and indecent articles and (b) sexual intercourse or gross indecency. Similarly, each state and territory have relevant legislation that requires the compliance of teachers for moral and ethical conduct. For your response, prepare a review paper of two cases that have been prosecuted and:

  • describe the two scenarios or incidents and their relevance to the state or territory criminal code,
  • identify the sections of the code or legislation that are relevant to the charges prosecuted, and sections where the accused were found guilty, and
  • critically analyse the two incidents and suggest strategic initiatives that a school may enact as way to avoid re-occurrence.
