Dorothy is a Registered Nurse who visits Mr Cook, a patient with an endotracheal tube, and attached to a ventilator. Mr Cook responds to Dorothy’s touch. She introduces herself and asks Mr Cook if he understands that the surgeon wants to take him back to the operating theatre and place support rods in his spine, in place of the bones that were removed. Mr Cook nods his head. Dorothy asks him ‘Do you want to have this surgery?’ and Mr Cook shakes his head “no”, slowly but purposefully.

Dorothy returns to the surgery department to speak to Dr Anton, the attending surgeon. She knows it is against hospital policy for a surgeon to sign a consent form unless it is an emergency procedure. She also thinks that Mr Cook needs someone to speak for him, but she doesn’t know how to go about finding someone. Dorothy finds Dr Anton and tells him that she had just been up to see Mr Cook in the critical care unit. She asks Dr Anton if he had spoken to Mr Cook about the surgery.

Dr Anton responds: I see no point in talking to him. He has a long history of mental retardation. Without the support of Harrington rods, he will never be able to sit up, let alone walk. He definitely needs the operation.
Dorothy has assisted with this type of procedures before. She knows it is an extremely complicated and lengthy operation that is hard on healthy adolescents, much less a terminally ill man who obviously does not want to go through the procedure. Dorothy hesitantly continues:

When I went in to see Mr Cook, he seemed to understand me and responded negatively when I brought up the surgery. I also noticed that the oncologist on the case doesn’t think any treatment would be helpful at this point. The prognosis is very poor.
Dr Anton responds: Just what are you saying? Are you suggesting that this operation is not indicated?
