Read the following scenario and answer all three (3) questions that follow. 

Scenario 

Mr Tao is a 74 year-old man who is of Asian background. He lives on his own and, since having a stroke 9 months ago, has been receiving in-home care through meals on wheels, including daily meals. Mr Tao speaks limited English. He has a daughter who speaks English and has weekly contact with him. 

Mr Tao has been receiving ‘English style’ meals for the past 9 months. He has never complained about the meals, appearing satisfied with the service being provided. Mary, a support worker for meals on wheels, has recently started working for Mr Tao. Aware that Mr Tao is from an Asian background, Mary believes it would be more culturally appropriate for him to receive ‘Chinese style’ meals. Mary discusses this with her Co-ordinator who agrees with Mary, changing Mr Tao’s meals to ‘Chinese style’. 

A week later, Mr Tao’s daughter called the meals on wheels co-ordinator inquiring as to why her father’s meals had been changed, and that her father did not like the new meals being delivered. The coordinator explained that, being from an Asian background, they thought Mr Tao would prefer Chinese meals. Mr Tao’s daughter informed the coordinator that her father was not Chinese, that he was in fact Taiwanese. 

1. Identify the cross-cultural conflict/misunderstanding. 

2. Why do you think this misunderstanding occurred? 

3. How should the worker and co-ordinator have handled this situation more appropriately? If your answer, Identify and explain at least three (3) communication strategies that could have been used to avoid any misunderstanding. 

Task 2 

Read the following scenario and answer all five (5) questions that follow. 

Scenario 

Hamid, a young man with an intellectual disability, shares a group home with two other people with intellectual disabilities, Ben and Steve, who are both in their late 20s. Hamid is turning 25 on Sunday. The staff (Jeff and Tracey) arranged to celebrate his birthday in his favorite Lebanese restaurant. They have invited Jayne, Anne and Peter from a nearby group home (run by the same organisation) to the celebration. 

This year, Hamid’s birthday falls within Ramadan. Jeff who is organising the celebration had organised for dinner at 7:00pm so that it would be after sunset. However, after discussions with staff from the other house the meal has been changed to 12:00noon as staff felt that it would be “too hectic to try and get all the clients ready for dinner on a Sunday night” (they all like to leave their shift on time on a Sunday night). 

When Hamid is advised, he tells Jeff that he won’t be able to eat because it is Ramadan and he is unable to eat through daylight. Jeff replies “ah come on Hamid, it won’t make any difference and who will know anyway?” Hamid is upset and says that he will be in trouble. Jeff tells him to stop carrying on and if he keeps whining he will cancel his birthday and Hamid won’t get any presents. Hamid still visibly upset goes to his room and slams the door. 

The restaurant is quite busy. Hamid, although happy to see everyone, is still upset and reluctant to order food. Jeff tells him to stop being stupid and orders Hamid’s favourite dish for him. Tracey takes some photos of the clients at lunch and downloads them onto her Facebook page, under the status “all having fun celebrating Hamid’s 25th Birthday”. 

All appear to enjoy the lunch, although Hamid does not eat much of his meal. 

The next afternoon, Jeff receives a call from Hamid’s sister, Samira, who is very upset as she has seen the photos of the dinner on Facebook; she asks “Why was Hamid at a restaurant eating through Ramadan?” Jeff explains that it was his birthday and that was the most convenient time for everyone. Samira is very upset that Hamid’s religion has been disrespected; she is also very upset that his photo was on Facebook. Neither Hamid nor his family had consented to photos of Hamid being published, in particular photos showing him eating and celebrating in Ramadan. Jeff says that he is very sorry and will remember for next time. 

When he hangs up he tells Tracey about the call saying “I can’t believe how ungrateful Hamid’s family are; they didn’t even say thank you for taking him out, and you’re in trouble for putting his photo on Facebook” Tracey responds ”You better let the boss know” Jeff says “Nah I reckon they will forget about it, I think I calmed her down, they don’t come to meetings or anything so we don’t need to do anything more about it...maybe you should take his photos off your Facebook.” 

1. Identify and briefly describe three (3) client legal rights that have been disregarded. 

2. Identify and briefly describe two (2) ethical breaches that have occurred. 

3. How could the staff have managed the situation more appropriately? 

4. Was there a breach of ‘duty of care’? Explain what this was and justify your answer. 

5. Complete a verbal report to your supervisor regarding the complaint made by Hamid’s sister.
